Terms of Service

1. Introduction and Acceptance of Terms

Welcome to Qutrek. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Qutrek Global LLC, a limited liability company organized under the laws of the State of Delaware, United States of America, with its registered address at 8 The Green, STE R, Dover, DE 19901, USA (“Qutrek,” “we,” “our,” or “us”).

Qutrek is the world's social exploration platform, where discovery becomes part of your daily life. Every day, real travelers and locals from around the world share the destinations they've fallen in love with, the adventures that changed them, the landmarks that left them speechless, the cultures that opened their minds, the nature that took their breath away, the stays that felt like home, and the quiet, charming moments in between, all through Treks.

These Terms govern your access to and use of the Qutrek mobile application, website, and all related services (collectively, the “Service”). By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not access or use the Service. We may update these Terms from time to time in accordance with Section 20 below.

Governing Documents:

Your use of the Service is also governed by the following documents, each of which is incorporated into these Terms by reference:

• Privacy Policy: describes how we collect, use, share, and protect your personal data.

• Community Guidelines: defines acceptable behavior and content standards on the platform.

2. Definitions

In these Terms, the following terms have the meanings set out below:

(Account) means the personal account you create to access and use the Service.

(Content) means any text, photos, videos, audio, graphics, location data, captions, messages, or other materials posted, uploaded, or shared through the Service.

(Community Guidelines) means the rules and standards for acceptable behavior and content on the Service, as published and updated by Qutrek from time to time.

(Personal Data) means any information relating to an identified or identifiable natural person, as defined under applicable data protection laws, including but not limited to the EU General Data Protection Regulation (GDPR), the UAE Personal Data Protection Law (PDPL), the California Consumer Privacy Act (CCPA/CPRA), and other applicable legislation. 

(Service) means Qutrek the world’s social exploration platform, including the mobile application, website, APIs, and all related features, tools, and services provided by Qutrek, through which Users create, share, and discover location tagged visual content (Treks) across six content categories: Activities, Landmarks, Stays, Moments, Culture, and Nature.

(Trek) means a content unit posted by a User on the Service, consisting of up to eight (8) photographs or one (1) video of up to sixty (60) seconds, tagged with a verified geographic location and assigned to one of six content categories (Activities, Landmarks, Stays, Moments, Culture, or Nature), representing a specific place or experience.

(User Content) means any Content that Users post, upload, submit, or otherwise make available through the Service, including Treks, captions, profile information, messages, and any associated metadata.

(User) or (you) mean any individual who accesses or uses the Service, whether or not they have created an Account.

(Explore) means to follow another User on the Service. When you explore another User, their Treks appear in your feed. Two Users who mutually explore each other are referred to as "Connections."

(Trekker) means a User who explores your Account (equivalent to a follower). Your Trekkers can see your Treks in their feed.

(Business Account) means an Account designated for businesses, organizations, or brands. Business Accounts are public by default and cannot be set to private. Regular User Accounts may be converted to a Business Account subject to Qutrek's approval and verification process.

(Saved Location) means a geographic location that a User saves to their profile for later use when creating a Trek. Saved Locations are accessible from the User’s profile.

3. Eligibility and Age Requirements

3.1 General Eligibility

To create an Account or use the Service, you must:

(a) Be at least thirteen (13) years old, or the minimum age required to use the Service without parental consent under the laws of your country or region, whichever is higher;

(b) Have the legal capacity to enter into these Terms; and

(c) Not have been previously suspended or permanently removed from the Service, unless Qutrek has expressly authorized you to create a new Account.

If you are under the age of legal majority in your country or region, you may use the Service only with the permission and supervision of your parent or legal guardian. Your parent or legal guardian should review these Terms with you.

Children below the applicable minimum age are not permitted to create an Account or use the Service.

3.2 Age Information and Verification

You must provide accurate and truthful information about your age and date of birth. Qutrek may use reasonable age screening or age assurance measures where necessary to protect Users, comply with applicable law, or enforce these Terms.

We may request additional information to confirm that you meet the applicable age requirement. If we reasonably believe that you are below the applicable minimum age, or that you have provided false age information, we may restrict, suspend, or terminate your Account and delete associated personal data in accordance with our Privacy Policy and applicable law.

3.3 Children’s Privacy

Qutrek is not directed to children below the minimum age required under Section 3.1, and such children are not permitted to create an Account or use the Service.

We do not knowingly collect personal data from anyone below the applicable minimum age. If we learn that a person below that age has created an Account or provided personal data through the Service, we may suspend or terminate the Account and take reasonable steps to delete the associated personal data, subject to applicable legal, safety, security, and record-retention requirements.

If you believe that a child below the applicable minimum age has created an Account or provided personal data to Qutrek, please contact us at support@qutrek.com.

4. Account Registration and Security

4.1 Account Creation

To access most features of the Service, you must create an Account. Qutrek uses password less authentication you sign in using your Apple ID, Google account, or Facebook account. When registering, you agree to: (a) provide accurate, current, and complete information; (b) maintain and promptly update your Account information; (c) maintain the security of your third party sign-in account (Apple, Google, or Facebook), as your Qutrek Account is accessed through it; and (d) immediately notify us of any unauthorized use of your Account.

4.2 Account Responsibility

You are solely responsible for all activity that occurs under your Account, whether or not authorized by you. Qutrek shall not be liable for any loss or damage arising from unauthorized access to your third party sign-in account (Apple, Google, or Facebook) that is used to access the Service.

4.3 Account Suspension and Termination

We may suspend or terminate your Account, at our sole discretion, if we reasonably believe that: (a) you have violated these Terms or the Community Guidelines; (b) your Account poses a security risk; (c) your Account is associated with fraudulent, abusive, or illegal activity; or (d) suspension or termination is required by applicable law or regulation.

If we suspend or terminate your Account, we will provide notice and an explanation of the reasons, unless doing so would compromise security, violate applicable law, or interfere with a legal investigation. You may appeal any suspension or termination decision through our internal complaint handling process described in Section 8.

4.4 Account Deletion by User

You may delete your Account at any time directly from within the Qutrek application by navigating to Settings > Account > Delete Account. Upon initiating account deletion:

• Your Account will be deactivated immediately and will no longer be accessible.

• Your User Content will be removed from public view within a reasonable period, typically within 30 days.

• Your personal data will be deleted in accordance with our Privacy Policy and applicable data retention obligations, subject to any legal requirements that may require us to retain certain data for a limited period (e.g., for regulatory compliance, legal claims, or fraud prevention).

• Account deletion is irreversible after the completion of the deletion process.

[Apple / Google] In compliance with Apple App Store Guideline 5.1.1(v) and Google Play’s Account Deletion Policy, account deletion is available directly within the application.

5. User Generated Content and License Grant

5.1 Your Content

The Service allows you to create, upload, post, and share User Content, including Treks. You retain all ownership rights in your User Content. Qutrek does not claim ownership of any User Content you submit.

5.2 License Grant to Qutrek

By submitting User Content to the Service, you grant Qutrek a worldwide, non-exclusive, royalty free, sub licensable (only to the extent necessary for the operation of the Service through authorized service providers), and transferable license to use, display, reproduce, adapt, modify, distribute, and create derivative works from your User Content, solely for the following purposes:

• Operating, providing, and maintaining the Service, including displaying your Treks to other Users;

• Promoting the Service through marketing and advertising, which may include featuring your User Content in promotional materials (you will be credited where reasonably practicable);

• Developing, improving, and enhancing the features and functionality of the Service;

• Conducting analytics and research to improve the user experience; and

• Complying with applicable legal obligations.

5.3 License Limitations

The license granted under Section 5.2 is subject to the following limitations:

• Qutrek will not sell your User Content to third parties without your separate, explicit consent.

• The license with respect to any specific User Content terminates when you delete that User Content from the Service or when you delete your Account, except: (a) to the extent the User Content has been shared with other Users who have not deleted it; (b) to the extent copies are retained in backup systems for a reasonable transition period (not exceeding 90 days); or (c) to the extent retention is required by applicable law.

5.4 Content Removal by User

You may delete your User Content at any time through the Service. We will make reasonable efforts to remove deleted content from our active systems promptly. However, residual copies may remain in backup systems for a limited period and may not be retrievable by other Users.

5.5 Representations and Warranties

By submitting User Content, you represent and warrant that: (a) you own or have the necessary rights, licenses, and permissions to submit the User Content and grant the license described herein; (b) the User Content does not infringe, misappropriate, or violate any third party’s intellectual property, privacy, publicity, or other rights; (c) the User Content does not violate applicable law; and (d) the User Content does not contain any material that is defamatory, obscene, or otherwise objectionable under these Terms or the Community Guidelines.

6. Community Guidelines and Prohibited Conduct

6.1 Community Guidelines

Qutrek is a community built on curiosity, cultural respect, and the shared joy of discovery. All Users must comply with our Community Guidelines, which are published as a separate document, available within the application under:

1) Settings > Help Center > Community Guidelines

2) And at https://qutrek.com/community-guidelines. The Community Guidelines are incorporated into these Terms by reference.

The Community Guidelines define, among other things: what content is and is not allowed on Qutrek; prohibited behaviors; our location integrity policy; our zero tolerance policy for child exploitation material, nonconsensual intimate images, and terrorism content; our enforcement process including how reports are handled; and our appeals process.

6.2 Acceptance of Community Guidelines

By creating an Account or uploading User Content, you confirm that you have read and agree to comply with the Community Guidelines. Qutrek may update the Community Guidelines from time to time. Material changes will be communicated to you in accordance with Section 20 of these Terms.

6.3 Consequences of Violations

Violations of these Terms or the Community Guidelines may result in one or more enforcement actions, depending on the nature, context, severity, and frequency of the violation. Such actions may include:

(a) Removal or restriction of the offending Content;

(b) A warning;

(c) Limitation of certain Account features;

(d) Temporary suspension of the Account; or

(e) Permanent termination of the Account.

Qutrek may take immediate action where we reasonably believe that Content or conduct involves child sexual exploitation or abuse material, nonconsensual intimate content, terrorism-related activity, credible threats, serious illegal activity, or an immediate risk of harm.

Where appropriate or required by applicable law, Qutrek may preserve relevant information and report suspected illegal activity to competent law-enforcement authorities or other authorized organizations.

Where the Digital Services Act applies, Qutrek will provide an accessible mechanism for reporting suspected illegal Content and will process qualifying notices in a timely, diligent, objective, and non-arbitrary manner.

6.4 Nonconsensual Intimate Images and Removal Requests

Qutrek prohibits the posting, uploading, sharing, or distribution of intimate images or videos without the consent of the person depicted. This prohibition applies to authentic content as well as digitally altered or artificially generated content that appears to depict an identifiable individual.

Registered Users may report suspected nonconsensual intimate content through the in-app reporting tools available on the relevant Content or User profile.

A person depicted in the reported content, or an authorized representative acting on that person’s behalf, may also submit a removal request by contacting support@qutrek.com with the subject line “Intimate Image Removal Request.”

The request must include sufficient information to identify and locate the content and must satisfy any declarations, signature requirements, or other conditions required by applicable law. Qutrek may request additional information reasonably necessary to verify and process the request.

Upon receiving a valid removal request covered by the U.S. TAKE IT DOWN Act, Qutrek will remove or disable access to the qualifying content within forty eight (48) hours and make reasonable efforts to identify and remove any known identical copies within the same period.

Qutrek may preserve limited information relating to the request or removed content where reasonably necessary to prevent re-uploading, preserve evidence, protect Users, investigate violations, comply with applicable law, or cooperate with lawful investigations.

7. Reporting, Blocking, and Safety Tools

7.1 In-App Reporting

Qutrek provides in-app tools that allow any User to report Content or behavior that they believe violates these Terms, the Community Guidelines, or applicable law. Reports can be submitted by tapping the report button available on any Trek or User profile.

Reports may also be submitted by non-registered users for illegal content, where required by applicable law. Contact us at support@qutrek.com for reports submitted outside the application. 

7.2 Blocking

Users may block other Users at any time through the Service. Blocking a User will prevent them from viewing your profile, Treks, and from interacting with your Content.

7.3 Action on Reports

Qutrek reviews reports submitted through the Service or sent to support@qutrek.com and may take any action we reasonably consider appropriate based on the nature, context, and severity of the reported Content or conduct.

Such action may include:

(a) Taking no action where we determine that no violation has occurred;

(b) Requesting additional information;

(c) Limiting the visibility or distribution of Content;

(d) Removing Content;

(e) Issuing a warning;

(f) Restricting certain Account features;

(g) Temporarily suspending an Account; or

(h) Permanently terminating an Account.

We may prioritize reports involving an immediate risk of harm, suspected illegal activity, child sexual exploitation or abuse material, credible threats, terrorism-related content, or nonconsensual intimate images.

Review times may vary depending on the seriousness and complexity of the report, the information available to us, and the volume of reports received. Any timeframes communicated by Qutrek are estimates unless a specific deadline is required by applicable law.

7.4 Notification of Moderation Decisions

Where reasonably practicable and required by applicable law, Qutrek may notify an affected User when we remove or restrict Content, limit Account functionality, or suspend or terminate an Account.

The notice may include the general reason for the decision and information about any available appeal process. We may withhold or limit notice where disclosure could:

(a) Create a safety or security risk;

(b) Reveal confidential moderation or detection methods;

(c) Interfere with an investigation;

(d) Facilitate further violations;

(e) Expose another person’s private information; or

(f) Violate applicable law.

Users entitled to additional information or procedural rights under applicable law will receive those rights as required.

8. Content Moderation and Appeals

8.1 Moderation Practices

Qutrek currently relies on human review to moderate Content and enforce these Terms, the Community Guidelines, and applicable law. Authorized Qutrek personnel may review reported Content, User activity, and other relevant information when assessing potential violations.

Qutrek may restrict access to or remove Content, limit Account functionality, suspend or terminate Accounts, or take other appropriate action based on the nature, context, and severity of the violation. In urgent cases involving suspected illegal Content, child sexual abuse material, credible threats, nonconsensual intimate images, or an immediate risk of harm, Qutrek may temporarily restrict or remove Content before completing a full review.

Qutrek may introduce automated moderation or content-detection tools in the future. Any such tools may be used to assist, prioritize, or support human review, subject to applicable law and Qutrek’s policies.

Private direct messages are end-to-end encrypted. Qutrek does not access, read, monitor, review, or moderate the content of private messages, and the moderation and review practices described in this Section do not apply to the content of private messages.

8.2 Internal Complaint and Appeal Mechanism

If you believe that Qutrek incorrectly removed or restricted your Content, limited your Account, or suspended or terminated your Account, you may submit an appeal by contacting support@qutrek.com and providing sufficient information to identify the decision being challenged.

Qutrek will review eligible appeals within a reasonable period, taking into account the complexity of the matter, the information provided, and the volume of requests received.

Where reasonably practicable, an appeal will be reviewed by a person who did not make the original decision. Qutrek may request additional information before reaching a decision.

We may reject or close appeals that are abusive, repetitive, manifestly unfounded, unrelated to a moderation decision, or submitted without sufficient information.

We will notify you of the outcome of the appeal where reasonably practicable and provide any additional information required by applicable law.

8.3 Out-of-Court Dispute Resolution

[EU / DSA Art. 21] Users in the EU/EEA who are dissatisfied with the outcome of the internal appeal process have the right to refer the matter to a certified out-of-court dispute settlement body under the Digital Services Act. Qutrek will engage in good faith with any such proceedings. Information about available dispute settlement bodies will be included in the moderation decision notification.

8.4 Trusted Flaggers

[EU / DSA Art. 22] Qutrek will prioritize reports submitted by entities designated as “trusted flaggers” by the relevant Digital Services Coordinator in EU/EEA member states, in accordance with the Digital Services Act. 

9. Privacy and Data Practices

9.1 Privacy Policy

Our collection, use, storage, sharing, and protection of your personal data are described in our Privacy Policy, available at https://qutrek.com/privacy-policy and accessible within the application under Settings > Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

By using the Service, you acknowledge that you have read and understood the Privacy Policy. Depending on your location, you may have rights regarding your personal data, including rights to access, correct, delete, restrict, object to the processing of, or obtain a copy of your personal data, as described in the Privacy Policy and provided by applicable law.

You may submit privacy questions or requests by contacting us at support@qutrek.com.

9.2 Data We Collect

As described in the Privacy Policy, we collect the following categories of personal data in connection with your use of the Service:

• Account information (name, email address, username, profile photo, date of birth);

• User Content, including Treks, photos, videos, and associated metadata;

• Precise geolocation data (when you create a Trek, save a location for later Trek creation, or when you grant location access);

• Device information (device type, operating system, unique device identifiers);

• Usage data (features used, interactions, browsing history within the Service);

• Communications data (support inquiries and feedback); and

• Information received from your sign-in provider (Apple ID, Google, or Facebook), including your name, email address, and profile photo as authorized by you during sign-in. Qutrek does not create or store passwords.

9.3 Lawful Basis for Processing

[EU / GDPR Art. 6] For Users in the EU/EEA, we process your personal data on the following lawful bases: (a) Consent for precise geo location data, marketing communications, and non-essential analytics; (b) Performance of a contract for processing necessary to provide the Service as described in these Terms; (c) Legitimate interests for security, fraud prevention, service improvement, and enforcing our Terms, where these interests are not overridden by your rights; (d) Legal obligation for processing required to comply with applicable law.

9.4 Consent Management

Where we rely on your consent for data processing, you will be presented with a clear, granular consent request at the relevant point of collection. Consent requests are specific to each processing purpose and are not bundled. You may withdraw your consent at any time through the application settings, and withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal. Withdrawing consent is as easy as giving it.

9.5 Third Party Data Sharing

We may share your personal data with the following categories of third parties, as described in the Privacy Policy: (a) cloud hosting and infrastructure providers; (b) analytics providers; (c) content delivery networks; (d) payment processors (where applicable); (e) moderation and safety tools; and (f) as required by applicable law or legal process.

We require all third party service providers to protect your data to the same standard as set out in our Privacy Policy. We do not sell your personal data to third parties.

[US / CCPA] For California residents: we do not “sell” your personal information as defined by the CCPA. If our data practices change, we will update our Privacy Policy and provide the required “Do Not Sell or Share My Personal Information” mechanism. See Section 16 for your California-specific rights.

10. Location Data and Permissions

10.1 Location Data Collection

Qutrek collects precise geolocation data when you create a Trek or when you save a location for later Trek creation. Location tagging is a core feature of the Service that enables content discovery based on geographic location. We collect this data only with your explicit permission, which is requested through your device’s operating system permission dialog. We do not track your location in the background.

10.2 Purpose and Use

Your location data is used for the following purposes: (a) tagging Treks to specific geographic locations; (b) enabling location based content discovery; (c) displaying nearby Treks and points of interest; and (d) improving the relevance of content recommendations.

10.3 Your Control

You may revoke location permissions at any time through your device’s settings. If you revoke location access, you will be unable to create new Treks (which require location tagging), but you may continue to browse and interact with existing content on the Service.

[EU / GDPR] Precise geolocation is processed on the basis of your explicit consent (GDPR Art. 6(1)(a)). You may withdraw consent at any time. Withdrawal does not affect the lawfulness of processing before withdrawal.

[US / CCPA] Precise geolocation is classified as “sensitive personal information” under the CCPA/CPRA. California residents have the right to limit its use. See Section 16.

11. Intellectual Property

11.1 Qutrek’s Intellectual Property

All rights, title, and interest in and to the Service, including but not limited to the Qutrek name, logo, trademarks, service marks, domain names, trade dress, design, layout, user interface, software, source code, databases, algorithms, features, functionality, and all related intellectual property (collectively, “Qutrek IP”), are and shall remain the exclusive property of Qutrek or its licensors.

The Qutrek IP is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Nothing in these Terms grants you any right to use the Qutrek IP except as expressly necessary to access and use the Service in compliance with these Terms. Any unauthorized use of Qutrek IP may result in suspension or termination of your Account and may give rise to legal action.

11.2 Copyright and Intellectual Property Claims

Qutrek respects the intellectual property rights of others and expects its Users to do the same. If you believe that your copyrighted work or other intellectual property has been copied, posted, or used on the Service in a way that infringes your rights, you may submit a written notice to us with the following information:

· A physical or electronic signature of the person authorized to act on behalf of the owner of the copyrighted work or intellectual property right;

· A description of the copyrighted work or intellectual property claimed to have been infringed;

· A description of where the allegedly infringing material is located on the Service, including a URL, screenshot, username, Trek details, or other information reasonably sufficient to help us locate the material;

· Your contact information, including your name, mailing address, email address, and telephone number;

· A statement that you have a good-faith belief that the use of the material is not authorized by the rights owner, its agent, or the law; and

· A statement that the information in your notice is accurate and that you are authorized to act on behalf of the rights owner.

11.3 Counter Notice

If you believe that your Content was removed or disabled by mistake or misidentification, you may submit a written counter notice to us at Qutrek Global LLC, Attn: Copyright Notices, 8 The Green, STE R, Dover, DE 19901, USA, or by email at support@qutrek.com. Your counter notice should include your physical or electronic signature, identification of the Content that was removed or disabled and its previous location on the Service if available, a statement that you have a good faith belief that the Content was removed or disabled as a result of mistake or misidentification, your name, mailing address, email address, telephone number, and any additional information reasonably necessary for us to review your request.

11.4 Repeat Infringer Policy

Qutrek will terminate the Accounts of Users who are found to be repeat infringers of intellectual property rights. We consider a “repeat infringer” to be any User who has been the subject of two or more valid infringement notices within any 12 month period.

12. Payments and Subscriptions

12.1 Current Service

Qutrek is currently available as a free service. All core features of the platform including creating and sharing Treks, discovering content and connecting with the community are available at no cost.

12.2 Future Paid Features

Qutrek may in the future introduce optional premium features, subscriptions, or in-app purchases. If and when paid features are introduced: (a) we will clearly communicate pricing, features, and terms before you are asked to make any payment; (b) all payments will be processed through your device’s app store (Apple App Store or Google Play Store) Qutrek does not directly process or store payment card information; (c) any subscription terms, including auto renewal and cancellation, will comply with Apple and Google’s billing policies and applicable consumer protection laws; and (d) these Terms will be updated to reflect the specific payment terms, with advance notice provided in accordance with Section 20.

12.3 No Charges without Consent

Qutrek will not charge you for any paid feature, subscription, or purchase unless the applicable price and payment terms are clearly presented to you and you provide any consent required by applicable law.

Qutrek may add, modify, limit, discontinue, or introduce charges for features of the Service from time to time. We will provide notice of any material pricing changes as required by applicable law.

You will not be charged retroactively for your previous use of a feature that was offered free of charge.

13. Third Party Services and Links

The Service may contain links to third party websites, services, applications, or advertisements that are not owned or controlled by Qutrek. Qutrek does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party services.

Your interactions with third-party services, including any purchases, communications, or disputes, are solely between you and the third party. Qutrek shall not be liable for any loss or damage of any kind incurred as a result of your dealings with any third-party services or as a result of the presence of third-party links or content on the Service.

We encourage you to review the terms and privacy policies of any third-party service before engaging with them.

14. Disclaimers and Limitation of Liability

14.1 “As Is” Disclaimer

THE SERVICE, INCLUDING ALL CONTENT, FEATURES, AND FUNCTIONALITY, IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QUTREK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AVAILABILITY, RELIABILITY, AND NON-INFRINGEMENT.

Qutrek does not warrant that: (a) the Service will meet your requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) any defects or errors will be corrected; (d) the results obtained from the Service will be accurate, reliable, or complete; or (e) the Service will be free from viruses, malware, or other harmful components.

14.2 User Content Disclaimer

Qutrek is a social discovery and travel platform where Users share their own photos, videos, stories, and travel experiences across six content categories: Activities, Landmarks, Stays, Moments, Culture, and Nature.

While Qutrek provides a space for exploration and cultural discovery, we do not independently verify or guarantee the accuracy, safety, legality, quality, or reliability of User Content, including travel recommendations, trail conditions, cultural events, accommodation reviews, location information, or any other user submitted material.

Treks are personal experiences shared by individual Users and may not reflect current conditions. You are solely responsible for evaluating and acting upon any User Content you encounter on the Service, and you should exercise your own judgment when making travel or activity decisions based on shared content. 

14.3 Location, Travel, and Activity Safety Disclaimer

Qutrek provides a platform for Users to share and discover locations, destinations, travel experiences, outdoor activities, cultural sites, accommodations, and other places of interest. Qutrek is not a navigation service, emergency service, travel agency, tour operator, safety authority, weather service, rescue service, or professional guide.

Location information, routes, directions, recommendations, accessibility details, opening hours, trail conditions, weather conditions, safety information, and other content available through the Service may be inaccurate, incomplete, outdated, unavailable, or unsuitable for your circumstances.

You are solely responsible for evaluating the safety, legality, accessibility, and suitability of any location, route, activity, destination, accommodation, or experience before relying on User Content or visiting or participating in it.

When using information obtained through the Service, you agree to:

(a) Exercise reasonable judgment and take appropriate safety precautions;

(b) Comply with all applicable laws, regulations, local rules, property restrictions, permits, warnings, and instructions;

(c) Avoid trespassing, entering restricted or dangerous areas, or participating in activities beyond your training, experience, health condition, or physical ability;

(d) Independently verify important information, including weather, road, trail, transportation, security, accessibility, and operating conditions;

(e) Use appropriate equipment, supervision, insurance, and professional guidance where reasonably necessary; and

(f) Contact the appropriate local emergency services in the event of an emergency.

Travel, outdoor recreation, water activities, climbing, hiking, diving, extreme sports, road trips, and similar activities may involve serious risks, including injury, illness, property damage, exposure to hazardous conditions, or death. You voluntarily assume the risks associated with your decisions, travel, and participation in such activities, except to the extent liability cannot be excluded under applicable law.

Qutrek does not guarantee that any location is safe, lawful to access, publicly accessible, accurately mapped, currently open, suitable for children, suitable for persons with disabilities, or appropriate for any particular activity.

14.4 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QUTREK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, REPUTATION, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO:

• Your access to, use of, or inability to access or use the Service;

• Reliance on content, recommendations, or information shared by other Users;

• Interactions with other Users, whether online or in person;

• Unauthorized access to or alteration of your User Content or Account;

• Deletion, loss, or failure to store or transmit any Content or communication;

• Any third-party services, links, or advertisements; or

• Any matter beyond our reasonable control.

IN NO EVENT SHALL QUTREK’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNTS YOU HAVE PAID TO QUTREK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED US DOLLARS (USD $100).

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY FOR: (A) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

[EU] For Users in the EU/EEA, the limitations above apply only to the extent permitted by applicable EU and member state law. Your statutory consumer rights under EU law are not affected by these Terms.

15. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Qutrek and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your violation of any third party’s rights, including intellectual property, privacy, or publicity rights.

[EU] For Users in the EU/EEA, this indemnification obligation applies only to the extent permitted by applicable consumer protection laws and does not restrict your statutory rights.

16. Your Data Rights

Depending on your jurisdiction, you may have specific rights regarding your personal data. This section summarizes the key rights available under major data protection frameworks. For full details, please refer to our Privacy Policy.

16.1 Rights for All Users

Regardless of your location, all Qutrek Users can: (a) access their Account information through the Service; (b) update or correct their Account information; (c) delete their Account and associated data through the in-app deletion feature; and (d) contact us at support@qutrek.com with questions about their data.

16.2 Rights for EU/EEA Users (GDPR)

If you are located in the EU or EEA, you have the following rights under the General Data Protection Regulation:

• Right of access: You may request a copy of the personal data we hold about you.

• Right to rectification: You may request correction of inaccurate or incomplete data.

• Right to erasure (“right to be forgotten”): You may request deletion of your personal data, subject to legal retention obligations.

• Right to restrict processing: You may request that we temporarily limit processing of your data while disputes or verifications are ongoing.

• Right to data portability: You may request your personal data in a structured, commonly used, machine-readable format (e.g., JSON), and have it transmitted to another controller where technically feasible.

• Right to object: You may object to processing based on legitimate interests or for direct marketing purposes.

• Right to withdraw consent: Where processing is based on consent, you may withdraw consent at any time without affecting the lawfulness of prior processing.

• Rights related to automated decision making: You have the right not to be subject to decisions based solely on automated processing, including profiling, that produce legal or similarly significant effects, except where authorized by law or based on your explicit consent.

To exercise any of these rights, contact our Data Protection Officer at support@qutrek.com. We will respond within 30 days. If we are unable to comply, we will explain the reasons.

You also have the right to lodge a complaint with your local data protection supervisory authority.

16.3 Rights for California Residents (CCPA/CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:

• Right to know: You may request disclosure of the categories and specific pieces of personal information we have collected, the sources, the business purposes, and the categories of third parties with whom we share it.

• Right to delete: You may request deletion of your personal information, subject to legal exceptions.

• Right to correct: You may request correction of inaccurate personal information.

• Right to opt out of sale or sharing: You have the right to opt out of the “sale” or “sharing” of your personal information for cross context behavioral advertising. Qutrek does not currently sell personal information. If this changes, we will provide a “Do Not Sell or Share My Personal Information” link.

• Right to limit use of sensitive personal information: You may direct us to limit the use of your sensitive personal information (including precise geolocation) to purposes necessary for performing the Service.

• Right to non-discrimination: We will not discriminate against you for exercising your privacy rights.

You may exercise these rights by contacting us at support@qutrek.com or through the in-app privacy settings. We will verify your identity and respond within 45 days. You may also designate an authorized agent to make requests on your behalf.

Qutrek honors Global Privacy Control (GPC) signals as a valid opt-out of sale/sharing where required by law.

16.4 Rights for UAE / MENA Users

If you are located in the United Arab Emirates, you have rights under the UAE Personal Data Protection Law (Federal Decree-Law No. 45/2021), including the right to access, correct, and delete your personal data. For Users in the Dubai International Financial Centre (DIFC), additional rights under the DIFC Data Protection Law (Law No. 5/2020, as amended in 2025) apply, including the right to bring claims for compensation in the DIFC courts for contravention of your data protection rights.

16.5 Rights for Users in Other Jurisdictions

Users in other jurisdictions may have additional rights under their local data protection laws. We are committed to respecting and supporting your data rights regardless of your location. Please contact us at support@qutrek.com to exercise any data rights available to you under applicable law.

17. International Data Transfers and Security

17.1 International Transfers

Qutrek operates globally, and your personal data may be transferred to and processed in countries other than the country in which you reside. These countries may have data protection laws that are different from (and, in some cases, less protective than) the laws of your jurisdiction.

When we transfer personal data outside of your jurisdiction, we implement appropriate safeguards to ensure your data remains protected in accordance with applicable law:

• For transfers from the EU/EEA: We rely on EU Standard Contractual Clauses (SCCs), adequacy decisions by the European Commission, or the EU-US Data Privacy Framework, as applicable.

• For transfers from the UAE: We comply with the transfer requirements of the UAE PDPL and, where applicable, the DIFC Data Protection Law.

• For transfers from other jurisdictions: We implement the safeguards required by applicable local data protection law.

17.2 Data Security

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, destruction, alteration, or disclosure. These measures include, but are not limited to, encryption of data in transit and at rest, access controls, regular security assessments, and employee training. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

17.3 Data Breach Notification

In the event of a personal data breach that poses a risk to your rights and freedoms, Qutrek will: (a) notify the relevant supervisory authority within 72 hours of becoming aware of the breach, where required by applicable law (including GDPR Art. 33); and (b) notify affected Users without undue delay where the breach is likely to result in a high risk to their rights and freedoms.

17.4 Data Retention

We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements. Specific retention periods are detailed in our Privacy Policy. When data is no longer needed, it is securely deleted or anonymized.

18. Algorithmic and AI Disclosures

18.1 Recommender Systems

Qutrek uses algorithmic systems to personalize your experience, including: (a) recommending Treks based on your location, interests, and interaction history; (b) ranking content in your discovery feed; and (c) suggesting Users or destinations you may find interesting. The main parameters used by our recommendation systems include geographic proximity, content popularity, recency, category preferences, and your past engagement patterns.

18.2 Non-Profiled Option

You have the right to access the Service without profiling-based content recommendations. Qutrek offers at least one content feed option that is not based on profiling of the User, such as a chronological feed or a location-based feed that does not take into account your personal interaction history.

[EU / DSA Art. 27] This disclosure is provided in compliance with the Digital Services Act’s transparency requirements for recommender systems.

18.3 AI Transparency

Qutrek does not currently use third-party artificial intelligence services to process Users’ personal data. If Qutrek introduces AI-powered features in the future that involve sharing personal data with third-party AI providers, we will clearly disclose the use of such services, the AI provider where appropriate; the types of data processed, and will obtain any required user consent before sharing personal data with such providers.

[Apple] In compliance with Apple App Store Guideline 5.1.2(i), as updated in November 2025, Qutrek discloses the use of any third-party AI and obtains explicit permission before sharing personal data with such services.

19. Dispute Resolution and Governing Law

19.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact Qutrek at support@qutrek.com and attempt to resolve the dispute informally. We will endeavor to resolve disputes through good-faith negotiations within 30 days of receiving your notice.

19.2 Governing Law

Except where otherwise required by mandatory applicable law, these Terms and any dispute or claim arising out of or relating to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

For Users located in the United States, these Terms are governed by the laws of the State of Delaware, United States.

For Users located in the European Union, European Economic Area, United Kingdom, or any other jurisdiction with mandatory consumer protection laws, nothing in these Terms limits or excludes any rights you may have under the mandatory laws of your country of residence.

19.3 Arbitration

For Users located in the United States, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved through informal negotiation shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules and Mediation Procedures, except where prohibited by applicable law.

Arbitration shall be conducted on an individual basis only. You and Qutrek agree that neither party may bring claims as a plaintiff or class member in any class, collective, consolidated, or representative action, except where such waiver is not permitted by applicable law.

By agreeing to these Terms, you acknowledge and agree that, to the fullest extent permitted by applicable law, you and Qutrek are each waiving the right to a trial by jury and the right to participate in a class, collective, consolidated, or representative action.

19.4 Small Claims Exception

Notwithstanding Section 19.3, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of such court.

19.5 EU Consumer Rights

Nothing in this Section restricts any mandatory rights or remedies available to you under the consumer protection laws of the European Union, European Economic Area, or your country of habitual residence.

If you are a consumer in the EU or EEA, you may bring proceedings before the courts available to you under applicable law, including, where applicable, the courts of your country of habitual residence.

You may also have access to an authorized consumer dispute resolution body or other alternative dispute resolution mechanism where available under applicable law.

20. Changes to These Terms

Qutrek may modify these Terms from time to time. When we make changes, we will update the “Last Updated” date at the top of these Terms. For material changes, we will provide notice through one or more of the following methods: (a) a prominent notice within the application; (b) an email to the address associated with your Account; or (c) a push notification.

Where required by applicable law, we will provide reasonable advance notice before material changes take effect.

If you do not agree to the modified Terms, you must stop using the Service before the changes take effect. Your continued use of the Service after the effective date of the modified Terms constitutes your acceptance of the revised Terms, except where applicable law requires another form of consent. 

21. General Provisions

21.1 Entire Agreement

These Terms, together with the Privacy Policy, Community Guidelines, constitute the entire agreement between you and Qutrek regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

21.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

21.3 Waiver

The failure of Qutrek to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

21.4 Assignment

You may not assign, transfer, delegate, sublicense, or otherwise dispose of these Terms, or any of your rights or obligations under these Terms, whether voluntarily, involuntarily, by operation of law, or otherwise. Any attempted assignment, transfer, or delegation by you will be null and void.

Qutrek may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, corporate reorganization, financing, sale of assets, change of control, or similar business transaction, or to an affiliate or successor, upon notice to you If required by applicable law.

21.5 Force Majeure

Qutrek shall not be liable for any failure or delay in performing its obligations under these Terms to the extent caused by events beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, strikes, governmental actions, or failures of third-party services.

21.6 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights, except as expressly stated herein.

21.7 Language

These Terms may be made available in multiple languages. In the event of a conflict between the English version and any translated version, the English version shall prevail, except where prohibited by applicable law.
